Telecom Talk – Shock To Telecom Companies From Supreme Court In AGR Case, Customers Will Also Not Get Relief

In the case of Adjusted gross revenue (AGR), telecom companies Bharti Airtel, Vodafone Idea and Tata Teleservices have once again got a setback from the Supreme Court.

The Supreme Court on Friday rejected the petition of telecom companies that there’s a calculation error within the demand for AGR. this suggests that the telecom companies will need to pay the whole dues. during this way, customers also will not get relief. Telecom companies have already been increasing the tariff to pay the AGR dues and may increase it further.

What was the demand of the companies

In its decision, the Supreme Court dismissed the petitions of these companies, refusing to re-calculate the AGR dues. These companies had stated that their AGR dues haven’t been figured out correctly; Therefore, keeping in mind the terms and conditions, they ought to be re-calculated. Then they will pay.

What is AGR Case

Adjusted gross revenue (AGR) is that the usage and license fee charged to telecom companies by the Department of Telecommunications (DoT) of the Ministry of Communications. it’s two parts – spectrum usage charge and license fee , which are 3-5 per cent and 8 per cent respectively. There was a dispute between the Department of Telecom and therefore the telecom companies regarding this.

Earlier in September last year, the Supreme Court, giving major relief to telecom companies within the case of Adjusted gross revenue (AGR), gave them 10 years to pay AGR dues. The court said that the telecom companies will have to pay 10 percent of the dues by 31 March 2021.
